NoseJourney – Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the NoseJourney platform and related services (“Service”), operated by NoseJourney Ltd, a company registered in London, United Kingdom (“NoseJourney”, “we”, “us”, “our”).

1. Acceptance of Terms

By creating an account, accessing or using the Service, you agree to be bound by these Terms and our Privacy Notice and Cookie Policy. If you do not agree, you must not use the Service.

2. Description of the Service

NoseJourney is an online platform that helps prospective patients discover and connect with rhinoplasty doctors and clinics. The Service provides doctor profiles, before/after case galleries, reviews, and algorithmic matching based on information you provide, including optional photo analysis.

NoseJourney is not a medical provider and does not offer diagnosis, treatment, or medical advice. Any decision to undergo a procedure is made solely between you and your chosen doctor or clinic.

3. Eligibility

  • You must be at least 18 years old to create an account and use the Service.

  • If you are using the Service on behalf of a clinic or company, you represent that you are authorised to bind that entity to these Terms.

4. User Accounts

  • You must provide accurate, complete and up‑to‑date information during registration.

  • You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

  • You must notify us immediately of any unauthorised use of your account.

5. Patient/User Responsibilities

  • Provide truthful information about your preferences and medical background to the extent you choose to share it.

  • Upload only photos and content that you have the legal right to share and that comply with these Terms.

  • Use the Service for personal, non‑commercial purposes only.

  • Consult a qualified medical professional for personalised medical advice before taking any decision regarding surgery or treatment.

6. Doctor and Clinic Responsibilities

  • Ensure that all professional information (qualifications, titles, experience, pricing, etc.) provided on NoseJourney is accurate and not misleading.

  • Comply with all applicable laws, professional rules, and advertising standards in your jurisdiction.

  • Obtain valid written consent from patients before uploading their photos (including before/after images) to the platform.

  • Respond to patient enquiries in a timely and professional manner.

7. Content and Intellectual Property

7.1 Your Content

You retain ownership of the content you upload to the Service (including photos, text, reviews, and profile information). By uploading or posting content, you grant NoseJourney a non‑exclusive, worldwide, royalty‑free licence to host, store, reproduce, display and distribute that content solely for the purposes of operating, improving and promoting the Service.

7.2 NoseJourney Content

The Service, including its design, software, branding, and all content created by NoseJourney (excluding your content and third‑party content), is owned by NoseJourney or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute or create derivative works from it without our prior written consent.

7.3 Prohibited Content

  • Illegal, defamatory, hateful, or discriminatory content.

  • Content that infringes any third‑party rights, including privacy, copyright, trademark or publicity rights.

  • Sexually explicit, obscene, or otherwise inappropriate images.

  • Content that promotes violence, self‑harm or unsafe medical practices.

8. Medical Disclaimer

Information on NoseJourney, including AI‑generated analyses, summaries, scores and content from doctors and other users, is provided for general information only. It does not constitute and must not be relied upon as medical advice or a substitute for consultation with qualified healthcare professionals.

NoseJourney does not endorse any particular doctor, clinic, treatment or outcome, and does not guarantee the accuracy, completeness or usefulness of any content.

9. Payments and Credits (if applicable)

NoseJourney may offer paid features or credit‑based systems for doctors and clinics (for example, credits to unlock patient enquiries). Pricing, payment terms and cancellation policies will be described in the relevant interface or separate commercial agreement.

Unless required by law, fees paid to NoseJourney are non‑refundable once the corresponding service has been provided.

10. Prohibited Uses

You agree not to:

  • Use the Service for any unlawful purpose.

  • Attempt to gain unauthorised access to the Service, other accounts or systems.

  • Scrape, crawl, or copy any part of the Service using automated means without our prior written consent.

  • Reverse engineer, decompile or attempt to derive the source code of the platform, except where permitted by law.

11. Privacy and Data Protection

Our processing of personal data, including the use of AI models such as Google Gemini for image and text analysis, is described in our Privacy Notice. By using the Service, you acknowledge that your personal data will be processed as described there.

12. Third‑Party Services

The Service may integrate or link to third‑party services (such as payment processors, video platforms, cloud or AI providers). NoseJourney is not responsible for these services and your use of them may be governed by separate terms and privacy policies.

13. Suspension and Termination

We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe that you have violated these Terms, pose a risk to other users, or for security or legal reasons.

You may stop using the Service and request deletion of your account at any time via your settings or by contacting us.

14. Disclaimers and Limitation of Liability

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, NoseJourney disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non‑infringement.

To the maximum extent permitted by law, NoseJourney will not be liable for any indirect, incidental, consequential or punitive damages, or for any loss of profits, revenues, data or goodwill, arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (for example, for death or personal injury caused by negligence, or for fraud).

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will provide reasonable notice (for example by email or an in‑app notice) and indicate the latest revision date at the top of this page. Your continued use of the Service after the changes become effective constitutes acceptance of the updated Terms.

16. Governing Law and Jurisdiction

These Terms and any disputes arising out of or in connection with them are governed by the laws of England and Wales, without regard to conflict of law principles.

The courts of England and Wales will have exclusive jurisdiction over any such disputes, subject to mandatory consumer protection rights that may apply in your country of residence.
